Iowa breath test machines can give inaccurate results

In a recent post we discussed the weaknesses of Iowa's standard field sobriety tests as evidence of intoxication. Field sobriety tests are generally used as an initial indicator of intoxication; if the arresting officer concludes the tests show a driver is drunk, the next step is usually a breath test. Blood tests are considered more accurate than breath tests but they are used less often because they are considered more invasive.

As one might expect, bartenders and servers are charged with "cutting off" a customer who has clearly had too much to drink. This act certainly takes courage and resolve, but it is sometimes a very necessary action that must be taken.

Potential changes in robbery sentencing on the horizon

Over the past three years, the Public Safety Advisory Board in Iowa has been calling for a change in sentencing requirements for those convicts robber. The Iowa House of Representatives listened, and on March 3, the House unanimously passed an amendment concerning the sentencing patterns of a person convicted of second-degree robbery.

Being pulled over on suspicion of drunk driving can be a humiliating experience, especially when you are asked to get out of your vehicle and perform some field sobriety tests at the side of the road. Iowa law enforcement officers use three standard tests: the walk-and-turn, the one-leg stand and the horizontal gaze nystagmus (HGN) test.
